Terms of Service (School Agreement)

1. The Agreement

This Terms of Service agreement governs the relationship between EDDI EDUCATION PTY LTD ("eddi") and the purchasing educational institution ("the School"). It outlines the provision of the eddi platform, including all of its subcomponents and functions.

2. Roles and Responsibilities

Under Australian Privacy Law, the School is the "Data Controller" and eddi acts strictly as the "Data Processor." The School is solely responsible for ensuring that the collection of sensitive data complies with relevant state and federal educational guidelines.

3. Consent Management and Account Activation

eddi provides automated consent management tools to assist the School in fulfilling its obligations under the Australian Privacy Principles. eddi enforces a strict consent gate for student account activation:

  • Students Under 15: Account access is technically restricted until explicit digital consent is recorded from the student's registered parent or guardian.
  • Students Aged 15 and Over: Account access requires digital consent from both the student and their registered parent or guardian before the profile becomes fully active.

4. Data Ownership

The School retains absolute ownership and intellectual property rights over all student, staff, and school data inputted into or generated within the eddi platform. eddi is granted a limited, non-exclusive license to process this data solely to provide the agreed-upon services.

5. Software Licensing and Open Source

eddi's core software codebase is open-source and licensed under the GNU Affero General Public License v3.0 (AGPL v3). However, this Agreement governs the secure, hosted, and managed instance of eddi provided as a Software-as-a-Service (SaaS) to the School. The School is purchasing the hosting, security, support, and infrastructure management services associated with the platform.

6. Security Standards

eddi commits to maintaining industry-standard security measures, including encryption of data at rest and in transit (TLS 1.3). We engage in regular independent security testing to ensure compliance with common Australian and Global standards.

7. Termination and Offboarding

Either party may terminate this agreement in accordance with the standard commercial terms outlined in the School's specific service contract. Upon termination, eddi guarantees a 30-day window during which the School will receive a full export of their database. Subsequently, all School data and dedicated infrastructure will be permanently purged.
